ESA Letters: What to Look For (and What to Avoid)

The Importance of a Clinical Assessment

An ESA letter is a legal document that should only be issued by a licensed mental health professional after a thorough evaluation of your needs. Because this letter carries weight under the Fair Housing Act, it must reflect a genuine therapeutic relationship. Avoid websites that promise instant letters after completing a brief quiz, as these documents are often rejected by landlords and do not satisfy legal requirements.

Red Flags to Watch Out For

If a service offers a "registration" or a "certificate" for your pet, be very cautious. There is no official government registry for emotional support animals in the United States. A legitimate letter must be written on the letterhead of a licensed healthcare provider, such as a counselor, social worker, or psychologist, who is currently treating you or has performed an assessment of your mental health condition.

What a Valid Letter Includes

A valid letter will verify that you have a mental health disability that is recognized by the DSM-5 and that the animal provides support that alleviates at least one symptom of that condition. It does not need to list the animal's name, but it should clearly indicate the professional's license number, their state of practice, and their contact information. This ensures that a housing provider can verify the authenticity of the document if they choose to do so.

Your Rights Under the Fair Housing Act

The Fair Housing Act allows individuals with disabilities to have ESAs in housing that otherwise prohibits pets. However, this is not an excuse to neglect your animal or property. As a client, you should work with a provider who understands the nuance of these laws and can help you advocate for your rights in a professional and respectful manner.
